These Terms are entered into between you and Yumzy, a Delaware corporation.

Principal Place of Business: United States.

These Terms govern your use of the Yumzy website, checkout system, and all related products and services (the “Services”).

Mandatory Individual Arbitration & Class Action Waiver

By purchasing from or using our Services, you agree that any dispute shall be resolved exclusively through binding individual arbitration and not in court, except as specifically provided herein.

You waive any right to participate in a class action, collective action, or representative proceeding.

Arbitration shall be administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this provision.

Any in-person arbitration shall occur in the State of Delaware, United States.

Mass Arbitration Protocol

If 25 or more similar arbitration claims are filed by the same or coordinated counsel, claims shall proceed in batches of 10. Remaining claims shall be stayed until earlier batches conclude.

Statutes of limitation are tolled during the batching process.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law rules.

Court proceedings permitted under these Terms shall occur exclusively in Delaware, United States.

Subscription & Automatic Renewal Terms

If you enroll in a subscription offering, you authorize recurring charges to your selected payment method at the frequency presented at checkout.

Subscription pricing may vary.

Subscriptions automatically renew unless canceled before the renewal date.

You may cancel by contacting customer support at [email protected] prior to renewal processing.

If you do not currently offer subscriptions, this section will apply only if subscription services are introduced in the future.

California Auto-Renewal Disclosure

For California residents and other applicable jurisdictions:

  • Automatic renewal terms will be presented clearly before checkout.
  • You will receive confirmation including recurring billing terms.
  • You may cancel at any time prior to renewal.
  • We provide a clear and accessible cancellation method.
  • Renewal reminders may be sent when required by law.

Refund Policy – Consumable Product Policy

Due to the consumable nature of our gummy products, all sales are final once shipped.

We do not accept returns of opened or used products.

If your product arrives damaged or incorrect, you must contact [email protected] within 48 hours of delivery with photographic proof.

Approved claims may qualify for a replacement or refund at our sole discretion.

Chargebacks may void refund eligibility.

Privacy & Data Collection

We collect and process personal information in accordance with our Privacy Policy.

We use analytics tools, cookies, tracking pixels, and similar technologies for advertising, analytics, fraud prevention, and site optimization.

Statements regarding our products have not been evaluated by the FDA.

Severability

If any provision of these Terms is found unenforceable, the remainder shall remain in effect.

Entire Agreement

These Terms constitute the entire agreement between you and Yumzy.
